Terms of Service

These Terms of Service ("Terms") govern your access to and use of the VeraWatch mobile application, the website at verawatch.app, and any related services (together, the "Service") provided by Shaked Nimrod ("VeraWatch", "we", "our", or "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

VeraWatch is a mobile application that uses artificial intelligence to analyse photographs of luxury watches and produce an authentication assessment together with a digital certificate (PDF). The Service is provided on a freemium basis: a limited number of scans may be available at no cost, and additional scans are available through one-time purchases or subscriptions made via the Apple App Store.

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Service. By creating an account, you represent that you meet this requirement and that the information you provide is accurate and complete. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

4. No guarantee of authenticity

VeraWatch is an analytical tool, not a definitive authentication. Modern counterfeit and "superclone" watches can be highly sophisticated, and certain attributes are only verifiable through physical inspection. The Service provides an assessment based on the photographs you submit and the AI's analysis of authentication signal points. The result is an opinion, not a warranty.

5. Purchases and subscriptions

All purchases are processed by Apple through the App Store and are subject to Apple's terms. Unless otherwise stated:

Subscriptions renew automatically until cancelled. You can manage and cancel subscriptions in your Apple ID account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued. Prices may change; we will give reasonable advance notice of any change.

6. Refunds

Because purchases are processed by Apple, refunds are handled directly by Apple in accordance with the App Store's refund policy. We do not have the technical ability to issue refunds on Apple's behalf. You can request a refund at reportaproblem.apple.com.

7. Your content

You retain ownership of the photographs you upload and any data you provide ("Your Content"). You grant us a limited, worldwide, royalty-free licence to host, process, and analyse Your Content solely to provide the Service to you, including transmitting photographs to our AI processor (Anthropic) for inference. We do not use Your Content to train models.

8. Our intellectual property

The Service, including the VeraWatch name, logo, software, designs, certificate templates, and other materials, is owned by us and protected by intellectual property laws. Except for the rights expressly granted in these Terms, no licence is granted to you.

9. Third-party services

The Service relies on third-party providers (including Apple, Supabase, Anthropic, and Cloudflare). Your use of those providers may be subject to their own terms. We are not responsible for the acts or omissions of third-party providers.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we are required to do so by law. Upon termination, your right to use the Service ceases; sections that by their nature should survive (including Sections 4, 7, 8, 11, 12, and 13) will survive.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation.

12. Limitation of liability

To the maximum extent permitted by law, in no event shall VeraWatch, its operator, or its affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with these Terms or your use of the Service.

Our total aggregate liability arising out of or related to these Terms shall not exceed the greater of (a) the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred US dollars ($100).

Nothing in these Terms limits any liability that cannot be limited under applicable law (for example, liability for fraud, death, or personal injury caused by negligence).

13. Indemnity

You agree to indemnify and hold harmless VeraWatch and its operator from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of (a) your use of the Service in violation of these Terms, (b) Your Content, or (c) your violation of any rights of a third party.

14. Governing law and disputes

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws principles. The competent courts of Tel Aviv–Jaffa, Israel, shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms, except where applicable law (including consumer-protection law in your country of residence) grants you rights to bring proceedings elsewhere.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the app or by email. Continued use of the Service after such changes constitutes acceptance of the revised Terms.
